Este artigo tem por objetivo investigar a filiação filosófica dos denominados direitos da natureza. A questão central deste texto é saber se é procedente afirmar que a concepção da natureza enquanto titular de direitos significa rompimento com a ética Antropocêntrica e, entre as correntes da ética Ambiental, qual delas está alinhada com tal perspectiva. Apesar de ser comum a tese de que os direitos da natureza denotam uma posição biocêntrica, este artigo conclui que a posição filosófica que realmente identifica esta (...) formulação é a da ética Ecocêntrica, o que não significa, a rigor, afastamento ou superação do antropocentrismo. investigam-se autores referenciais para a problemática, bem como a legislação constitucional do Equador e da Bolívia. indaga-se também a fundamentação que justificaria reconhecer direitos à natureza, mas não reconhecer direitos aos animais. A metodologia adotada implica análise da bibliografia basilar acerca do tema, que é basicamente de origem estrangeira: europeia, estadunidense e sul-americana. A importância do tema está no exame jusfilosófico da virada paradigmática proposta pela ética Ambiental, notadamente pela ética Animal. Atribuir direitos à natureza significa rever essencialmente os critérios tradicionalmente empregados pelo Direito para o reconhecimento de direitos subjetivos. (shrink)

O artigo se propõe a pensar o retorno dos adolescentes às escolas após a pandemia fazendo a articulação entre conceitos psicanalíticos e a importância da escola na transição que a adolescência representa para a constituição psíquica do sujeito. A partir de uma experiência de pesquisa-extensão em uma escola com estudantes do Ensino Médio, pensamos sobre como o laço social contemporâneo impacta os modos de subjetivação e a educação, relacionando-o ao mal-estar nos estudantes adolescentes nos contextos educativos brasileiros. Além disso, a (...) dimensão da temporalidade tanto a própria da adolescência, quanto da escola e da pandemia que lhe atravessam foram tomadas como direcionamentos sendo o artigo dividido três partes: tempo na pandemia, tempo da escola e o tempo da adolescência. A partir do século XVIII, a imposição do controle das principais instituições políticas e sociais à população passa a ocorrer precipuamente por meio de estratégias urbanísticas. A arquitetura revela o objetivo de disciplinamento dos corpos de modo a prepará-los para a inserção na incipiente sociedade capitalista, seja na forma das escolas, fábricas ou prisões. Objetivamos num primeiro momento refletir, por meio da trajetória histórica e arquitetônica da Biblioteca Pública Municipal de Marília, se a biblioteca antiga tem preponderância de uma instituição (...) disciplinar; para, em um segundo momento, apresentar a arquitetura no novo prédio, verificando se o novo modelo de biblioteca pode evidenciar a transição do modelo disciplinar ao de controle. Metodologicamente, trata-se de uma pesquisa de natureza qualitativa, documental e bibliográfica, na qual utilizamos o método Análise de Conteúdo da Bardin para analisarmos categorias de entrevista. Para tanto, nos valemos um pouco do pensamento de Foucault e Deleuze acerca do tema, bem como o histórico, arquitetura e um pouco da organização das coleções da biblioteca em questão, nos espaços e tempos diferentes. Concluímos que a nova biblioteca não é melhor do que a anterior. Ela apenas se adequa melhor aos ditames dos novos tempos, com novas perspectivas sociais e tecnológicas. A antiga biblioteca teve uma função muito importante na história da cidade e dos seus usuários. Somente não estava mais apropriada ao século XXI, necessitando de novo aspecto e sentido. (shrink)

“X-Firsters” hold that there is some normative feature that is fundamental to all others (and, often, that there’s some normative feature that is the “mark of the normative”: all other normative properties have it, and are normative in virtue of having it). This view is taken as a starting point in the debate about which X is “on first.” Little has been said about whether or why we should be X-Firsters, or what we should think about normativity if we aren’t (...) X-Firsters. Hence the chapter’s two main goals. First, to provide a simple argument that one shouldn’t be an X-Firster about the normative domain, which starts with the observation that analogous views have dubious merits in analogous domains. Second, to offer an alternative view—taking normativity to be a determinable explained in terms of its determinates—that offers an interesting way to think about the structure and unity of normativity. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. I ask you to X. You now have a reason to X. My request gave you a reason. How? One unpopular theory is the epistemic account, according to which requests do not create any new reasons but instead simply reveal information. For instance, my request that you X reveals that I desire that you X, and my desire gives you a reason to X. Peter Schaber has recently attacked both the epistemic account and other theories of the reason-giving force of (...) requests. Schaber defends a new theory of the reason-giving force of requests according to which request give reasons because it is valuable for requesters and requestees that requests have this power. In this paper I argue that Schaber's attack on the epistemic account fails, and that his own theory ought to be rejected because it faces compelling objections. (shrink)

Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of exclusion that (...) has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits (...) of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

Partindo da noção de discurso de Michel Foucault buscamos pontuar os efeitos das falas comumente admitidas sobre o(a) professor(a) nos meios sociais e as formas como essas falas corroboram a instituição da figura do(a) bom(boa) professor(a). Para tanto recorremos aos textos publicados na seção "Obrigado, professor" da revista Nova Escola, sobre os quais empreendemos nossa análise.

Este artigo investe na ideia de que a infância é um dispositivo histórico do poder. Tem-se como referência analítica Michel Foucault, que concebe a noção de dispositivo em suas discussões a respeito da sexualidade. A hipótese geradora é a de que, a partir do momento em que a criança se torna um dos grupos estratégicos do dispositivo da sexualidade, produz-se sobre ela um conjunto heterogêneo de regimes de verdades e práticas que configura uma maneira de ser e ter uma infância, (...) influindo significativamente nas perspectivas pedagógicas modernas. Dialogando com Deleuze, Agamben e Veyne, considera-se que todo dispositivo possui: linhas de visibilidade e de enunciação que são, respectivamente, máquinas de “fazer ver” e de “fazer falar” ; linhas de força, que sustentam os campos de visibilidade e os regimes de enunciabilidade; e linhas de subjetivação que são, segundo Deleuze a dimensão do “si próprio” e que configuram o sujeito infantil. Apresenta-se três grupos de práticas articuladas às estas características do dispositivo: as práticas pedagógicas, as práticas divisórias e identitárias de gênero e de sexualidade e as práticas médicas. Observa-se que, para Foucault, o dispositivo da sexualidade disciplina os corpos, regula e normatiza a população, regulamenta o prazer e os saberes sobre o sexo, e, além disso, ocupa-se, por meio desse regime sobre o sexo, da preservação da espécie humana. A infância como dispositivo, na perspectiva ora apresentada neste artigo, também regulamenta a criança, constituindo-a em “sujeito infantil”, estabelecendo uma pedagogia e uma ciência que compuseram o pensamento pedagógico moderno sobre e para infância, ocupando-se também da preservação e da manutenção dessa espécie outra, a criança. Cognitive representations are typically analysed in terms of content, vehicle and format. While current work on formats appeals to intuitions about external representations, such as words and maps, in this paper we develop a computational view of formats that does not rely on intuitions. In our view, formats are individuated by the computational profiles of vehicles, i.e., the set of constraints that fix the computational transformations vehicles can undergo. The resulting picture is strongly pluralistic, it makes space for a variety (...) of different formats, and is intimately tied to the computational approach to cognition in cognitive science and artificial intelligence. Motion—and, in particular, local motion or change in location—plays a central role in Kenelm Digby’s natural philosophy and in his arguments for the immateriality of the soul. Despite this, Digby’s account of what motion consists in has yet to receive much scholarly attention. In this paper, I advance a novel interpretation of Digby on motion. According to it, Digby holds that for a body to move is for it to divide from and unify with other bodies. This is a view (...) of motion—as change in relations of parthood—that Alison Peterman attributes to Digby’s contemporary and acquaintance, Margaret Cavendish. Having shown that Digby’s presentation of the view predates Cavendish’s by more than a decade, I make a case that Digby’s work influenced Cavendish’s on this topic. In developing and defending my reading, I consider to what extent the Digbean account of motion and the arguments for it accord with the ideals of the mechanical philosophy emerging in the early modern period. Abstract This paper offers an appraisal of Phillip Pettit's approach to the problem how a merely finite set of examples can serve to represent a determinate rule, given that indefinitely many rules can be extrapolated from any such set. I argue that Pettit's so-called ethnocentric theory of rule-following fails to deliver the solution to this problem he sets out to provide. More constructively, I consider what further provisions are needed in order to advance Pettit's general approach to the problem. I (...) conclude that what is needed is an account that, whilst it affirms the view that agents' responses are constitutively involved in the exemplification of rules, does not allow such responses the pride of place they have in Pettit's theory. O texto defende que afetos tais como orgulho, vaidade, inveja, busca de honra e glória, são estruturantes para a argumentação hobbesiana. Sustenta-se que sem tais afetos o estado de natureza não seria um estado de guerra, mas um estado de paz e concórdia, como defendido por Locke. Ademais, sem a consideração de tais afetos, o design do Leviatã seria fundamentalmente diferente, visto que as leis naturais que devem configurá-lo, só são compreensíveis em seu conteúdo se se pressupuser a autoconservação de (...) seres orgulhosos, vaidosos, invejosos e que buscam honra e glória. Sem tal consideração, o Estado não só se mostraria ineficaz enquanto dispositivo de segurança para os humanos, como seria instável. Portanto, pressupor e conter tais traços afetivos é fundamental para a viabilidade e a estabilidade do Leviatã. Por fim, o texto desenha uma hipótese a respeito dos fundamentos a partir dos quais o ser humano apresenta tais traços afetivos, bem como a respeito do modo de conhecê-los. (shrink)

This book is a study of the role of intellect in human action as described by Thomas Aquinas. One of its primary aims is to compare the interpretation of Aristotle by Aquinas with the lines of interpretation offered in contemporary Aristotelian scholarship. The book seeks to clarify the problems involved in the appropriation of Aristotle's theory by a Christian theologian, including such topics as the practical syllogism and the problems of akrasia. Westberg argues that Aquinas was much closer to Aristotle (...) than is often recognized, and he puts forward important new interpretations of the relation of intellect and will in the stages of intention, deliberation, decision, and execution. In the concluding section of the book, he shows how this new interpretation yields fruitful insights on a range of theological topics, including sin, law, love, and the moral virtues. (shrink)

uma das teses fundamentais de Habermas no que diz respeito à relação entre direito e moral é que o direito alivia três exigências que são feitas à moral, quais sejam, exigência cognitivas, motivacionais e organizacionais. Os defensores de uma relação forte entre direito e moral, como por exemplo Dworkin, sustentam que a moral deve ser chamada para resolver os casos difíceis do direito. Ora, Habermas parece afirmar justamente o contrário, a saber, que é o direito que é chamado a suprir (...) um déficit cognitivo da moral. O texto explora as consequências dessa afirmação para a teoria discursiva do direito de Habermas, em relação a uma das teses fundamentais do positivismo jurídico, qual seja, a de que a moral não pode ser um fundamento para o direito justamente por causa de sua indeterminação cognitiva, razão pela qual os positivistas jurídicos afirmam o elemento de decisão última da autoridade do direito, sem que, para tal, o conteúdo seja o ponto determinante. O texto coteja o quanto a teoria discursiva do direito de Habermas se aproxima ou se afasta dessa tese fundamental do positivismo jurídico. (shrink)

I suggest that Hegel’s approach to naturalism should be understood as ‘formal’, and argue that Hegel’s Logic, particularly the section on the ‘Idea’, provides us with a method for this approach. In the first part of the paper, I present an (...) interpretation of Hegel’s method in which life plays a central role. In the second part of the paper, I develop Hegel’s method by providing a reading of Hegel’s Subjective Spirit, focusing on the sections ‘Anthropology’ and ‘Phenomenology’ in particular, arguing that they display the dialectic between life and cognition outlined by Hegel’s Idea. An influential view in cognitive science is that computation in cognitive systems is semantic, conceptually depending on representation: to compute is to manipulate representations. I argue that accepting the non-semantic teleomechanistic view of computation lays the ground for a promising alternative strategy, in which computation helps to explain and naturalise representation, rather than the other way around. I show that this computation-based approach to representation presents six decisive advantages over the semantic view. I claim that it can improve the two (...) most influential current theories of representation, teleosemantics and structural representation, by providing them with precious tools to tackle some of their main shortcomings. In addition, the computation-based approach opens up interesting new theoretical paths for the project of naturalising representation, in which teleology plays a role in individuating computations, but not representations. O último livro escrito por Nietzsche, Ecce homo: como alguém se torna o que se é, é uma de suas obras mais controversas, tendo sido tomada como sinal de prepotência, como autoexposição egocêntrica e como prenúncio do colapso que interrompeu sua trajetória intelectual em janeiro de 1889. As controvérsias foram alimentadas, em parte, pela peculiar narrativa encontrada no livro – ele conta a si sua vida e obra em tom elogioso e hiperbólico –, em parte, pelo fato de que a (...) tardia publicação de Ecce homo, ocorrida apenas em 1908, favoreceu o contraste com o apócrifo A vontade de poder – reunião de anotações publicada em 1901 como ‘obra principal’ de Nietzsche. Nosso propósito neste artigo é refletir sobre as possíveis contribuições do teor ‘autobiográfico’ e ‘autocrítico’ de Ecce homo para o caminho de pensamento do filósofo alemão. Nossa hipótese é que a narrativa experimentada no livro possui uma íntima relação com temas precedentes da obra nietzschiana e com a tarefa da transvaloração de todos os valores. Por meio de uma autoencenação, da colocação de um certo ‘Nietzsche’ em cena, o filósofo avança em sua crítica à metafísica – e à sua versão popular, a moral cristã – enquanto realça a mundanidade de sua perspectiva, seu caráter contingente e seu condicionamento pelas “pequenas coisas”, decisão que nos parece carregar uma relevante dimensão filosófica: Nietzsche assume a parcialidade e explicita o interesse envolvido em sua tomada de posição no seio da cultura. The problem known as Buridan’s Ass says that a hungry donkey equipoised between two identical bales of hay will starve to death. Indecision kills the ass. Some philosophers worry about human analogs. Computer scientists since the 1960s have known about the computer versions of such cases. From what Leslie Lamport calls ‘Buridan’s Principle’—a discrete decision based on a continuous range of input-values cannot be made in a bounded time—it follows that the possibilities for human analogs of Buridan’s Ass are far (...) more wide-ranging and securely provable than has been acknowledged in philosophy. We are never necessarily decisive. This is mathematically provable. I explore four consequences: first, increased interest of the literature’s solutions to Buridan’s Ass; second, a new asymmetry between responsibility for omissions and responsibility for actions; third, clarification of the standard account of akrasia; and, fourth, clarification of the role of credences in normative decision-theory. According to ethical objectivism, what a person should do depends on the facts, as opposed to their perspective on the facts. A long-standing challenge to this view is that it fails to accommodate the role that norms play in guiding a person’s action. Roughly, if the facts that determine what a person should do lie beyond their ken, they cannot inform a person’s deliberations. This paper explores two recent developments of this line of thought. Both focus on the epistemic counterpart (...) to ethical objectivism, according to which what a person should believe depends on the facts, as opposed to their perspective on the facts. The suggestion in each case is that epistemic objectivism faces a distinctive problem in accommodating guidance. Insofar as objectivism concerning the epistemic domain stands or falls with objectivism concerning the ethical domain, this is a problem for objectivism more generally. In this paper, I show that those arguments are not successful. The upshot is that the objectivist – whether ethical or epistemic – need not reject the idea that norms serve a guiding function. This essay considers the critical response to Hegel's view of Socrates we find in Kierkegaard's dissertation, The Concept of Irony. I argue that this dispute turns on the question whether or not the examination of particular thinkers enters into Socrates’ most basic aims and interests. I go on to show how Kierkegaard's account, which relies on an affirmative answer to this question, enables him to provide a cogent defence of Socrates' philosophical practice against Hegel's criticisms.

Can a liberal state exclude illiberal immigrants in order to preserve its liberal status? Hrishikesh Joshi has argued that liberalism cannot require a commitment to open borders because this would entail that liberalism is committed to its own demise in circumstances in which many illiberal immigrants aim to immigrate into a liberal society. I argue that liberalism is committed to its own demise in certain circumstances, but that this is not as bad as it may appear. Liberalism’s commitment to its (...) own demise is merely a reflection of the fact that it must take into account the rights of outsiders, not just the rights of existing citizens, and of the fact that circumstances of injustice can sometimes leave liberal societies with no correct choice. The concept of indiscernibility in a structure is analysed with the aim of emphasizing that in asserting that two objects are indiscernible, it is useful to consider these objects as members of (the domain of) a structure. A case for this usefulness is presented by examining the consequences of this view to the philosophical discussion on identity and indiscernibility in quantum theory.

Este presente artigo visa buscar os pressupostos da dupla reflexão de Climacus para melhor compreender a sua crítica ao pensamento dialético-especulativo. É tendo em mente que a dupla reflexão retoma os conceitos do trágico e do cômico, da seriedade e do gracejo – ainda que sobre uma nova perspectiva– que compreenderemos a importância dessa comunicação para a linguagem indireta, que tem por objetivo comunicar uma contradição absoluta.

Mandatory minimum sentencing provisions have been a feature of the U.S. justice system since 1790. But they have expanded considerably under the war on drugs, and their use has expanded considerably under the Trump Administration; some states are also poised to expand drug-related mandatory minimums further in efforts to fight the current opioid epidemic. In this paper I outline and evaluate three prominent arguments for and against the use of mandatory minimums in the war on drugs—they appeal, respectively, to proportionality, (...) consistency, and efficiency. I ultimately defend the view that the use of mandatory minimums in the war on drugs is unjust. -/- . (shrink)

This paper proposes an alternative view of the connection between knowledge and truth. Truth is traditionally seen as a semantic notion, i.e. a relation between what we say about the world and the world itself. Epistemologists and philosophers of science are therefore apt to resort to correspondence theories of truth in order to deal with the question whether our theories and beliefs are true. Correspondence theories try to define truth, but, in order to do so, they must choose a truth (...) bearer, i.e. something capable of being true, for instance, propositions, sentences or statements. According to the analysis here proposed, none of these truth bearers can be defined without reference to the others. The pragmatic, alternative view here presented, in its turn, is unaffected by this kind of conceptual difficulty. According to this view, one must focus on the use of truth terms – such as ‘true’, ‘false’, ‘correct’, ‘appropriate’, etc. – and the methodological role such terms play in the investigative practices and research programs to be found both in the sciences and in other, everyday investigative activities, such as forensic and journalistic investigations.
